Homeowner Associations (HOA)
Homeowner associations are formal legal entities created by a real estate developer to enforce the covenants, conditions and restrictions; collect dues; and manage the common amenities within the boundaries of the development. They typically operate as nonprofit corporations. To operate as a nonprofit corporation, homeowner associations must maintain an active registration with the Secretary of State. Membership in a homeowners association is mandatory for all property owners. A board of elected resident-homeowners provides leadership for these organizations. Participation in meetings and activities of the association is voluntary; however, decisions of the board and a majority of the members apply to all property owners and residents.
